The rules applied
Advance tax is payable where the tax for the year, after TDS and TCS, exceeds ₹10,000: 15% by 15 June, 45% by 15 September, 75% by 15 December and 100% by 15 March (cumulative). Taxpayers under the presumptive schemes of section 58 (44AD and 44ADA) pay the whole amount by 15 March. Resident senior citizens without business or professional income are exempt. Section 425 (234C) charges 1% a month for three months on the shortfall at each of the first three dates — with no charge for June if at least 12% was paid, and none for September if at least 36% was paid — and 1% for one month on the shortfall at 15 March; instalment shortfalls arising only from capital gains or lottery winnings are excused where the tax is paid in the next instalment. Section 424 (234B) applies where advance tax paid by 31 March is less than 90% of the assessed tax: 1% a month, or part of a month, from 1 April on the unpaid amount until it is paid. Tax paid by 31 March counts as advance tax for section 424 (234B). Interest is computed on the amount rounded down to the nearest ₹100 (rule 119A). Read our note on due dates.
