Fees are charged for each class and each mark. The lower fee for startups and small enterprises needs supporting proof, such as Startup India recognition from the Department for Promotion of Industry and Internal Trade (DPIIT) or Udyam registration. Our professional fee is separate and agreed in writing.

From search to registration

    Search and class

    We search the Trade Marks Registry for similar marks and identify the right classes under the Nice Classification (the international list of 45 classes of goods and services). A search reduces, but cannot remove, the risk of objection or opposition.

    Filing

    Your application is filed in Form TM-A by our registered trademark agent, under your authorisation in Form TM-M. Businesses in Mumbai & Thane file with the Registry's Mumbai office.

    Formalities and examination

    Any deficiency notice must be answered within one month. If the examiner raises objections, the reply to the examination report is due within one month of receiving it, and a hearing may follow.

    Advertisement and opposition

    Once accepted, the mark is advertised in the Trade Marks Journal. Anyone can oppose it within four months.

    Registration

    If there is no opposition, or it is decided in your favour, the mark is registered and a certificate is issued. Registration counts from the date of application.

After registration

  • A registration lasts 10 years from the application date and can be renewed for further 10-year periods.
  • Renewal can be filed up to one year before expiry. A six-month grace period with a surcharge follows expiry, and restoration is possible within the next six months.
  • Use ® only once the mark is registered. Representing an unregistered mark as registered can attract a penalty of 0.5% of turnover or ₹5 lakh, whichever is less. ™ is commonly used for marks that are not yet registered.
  • Watch the Trade Marks Journal for similar marks so that you can oppose them in time.

Frequently asked questions

Who can file a trademark application?

The applicant can file directly, or through a registered trademark agent or an advocate. Our filings are made by our registered trademark agent under your authorisation in Form TM-M.

How long does registration take?

It depends on objections and oppositions, and registration is decided by the Registrar. Expedited examination — requested by e-filing once the application number is issued, for a higher fee — ordinarily brings the examination within three months of the request. It speeds up examination only; it does not shorten the four-month opposition period or guarantee acceptance.

Can I use my brand while the application is pending?

Generally yes, provided it does not infringe anyone's earlier rights — the search helps check this. You can use ™ while it is pending, but not ® until it is registered.

Do I need a separate application for each class?

One application can cover several classes, but the official fee is charged for each class.
