The rules applied

Gains on each transfer of a virtual digital asset are taxed at 30% under section 194 (115BBH) with only the cost of acquisition deductible. A loss on any asset is ignored — it cannot reduce gains on other assets or other income, and cannot be carried forward. Health and education cess of 4% applies, and surcharge applies where total income exceeds ₹50 lakh. Tax deducted at source under section 393 (194S of the 1961 Act) (1% of the sale consideration) is credited against the tax due. Every transfer is reported in Schedule VDA; foreign exchange accounts held by residents are reported in Schedule FA. Read our full note on crypto tax.

Questions we are asked

How is crypto tax calculated in India? Gains on each transfer of a virtual digital asset are taxed at 30% under section 194 (115BBH), with only the cost of acquisition deductible. Health and education cess of 4% applies, and surcharge applies where total income exceeds ₹50 lakh.

Can crypto losses be set off or carried forward in India? No. A loss on any virtual digital asset is ignored: it cannot reduce gains on other assets or other income, and it cannot be carried forward.

How does the 1% TDS on crypto sales work? Tax deducted at source under section 393 (194S), at 1% of the sale consideration, shows in Form 26AS and is credited against your total tax for the year; any excess is refunded when you file the return.

How are crypto-to-crypto swaps, airdrops and staking rewards treated, and where are crypto transfers reported? For a crypto-to-crypto swap, the sale value is the rupee value of what was received. Airdrops and staking rewards are generally taxed as income when received, at their value then, and that value becomes their cost when they are later sold. Every crypto transfer is reported in Schedule VDA.
